By using the Tipping Point Tech Hub you agree to the following terms and conditions.

Tipping Point UK provides a range of digital tools that groups and individuals can use to support their activities. You must abide by the terms of service for each specific tool you use:

TIpping Point UK hosts various services on our own servers, the below terms apply. These services are:

Prohibited Material

You may not, and may not allow any third‐party, including its users, to use the Services to display, store, process or transmit, or permit use of the Services to display, store, process or transmit:

  • Material that is party political or violates Electoral Commission Guidance or Charity Commission Guidance on political activity.
  • Material that infringes or misappropriates a third party’s intellectual property or proprietary rights;
  • Hate‐related or violent material, and/or material advocating discrimination against individuals or groups;
  • Material advocating or advancing criminal hacking, cracking, or phishing;
  • Malicious material, including material that supports or facilitates unlawful, hateful, discriminatory, or violent causes;
  • Unlawful software;
  • Malicious code, such as viruses, worms, time bombs, Trojan horses and other harmful or malicious files, scripts, agents or programs; or
  • Material that violates, encourages or furthers conduct that would violate any applicable local, national, or international laws or regulations, including any criminal laws, or any third‐party rights, including publicity or privacy rights.
Prohibited Actions

You may not use the Services to, nor allow your users or any third‐party to use the Services to:

  • Promote, facilitate or encourage illegal activity;
  • Violate the Transparency of Lobbying, Non-party Campaigning and Trade Union Administration Bill (Lobbying Act) see Electoral Commission Guidance and NVCO for advice. 
  • Violate Charity Commission Guidance on political activity
  • Violate or facilitate violation of applicable data protection, privacy or electronic communications laws, including Tipping Point’s Privacy Policy
  • Generate or facilitate unsolicited commercial email (spam);
  • Send, upload, distribute or disseminate, or offer to do the same with respect to, unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, excessively profane, hateful, violent, or otherwise objectionable material, or promote, support or facilitate unlawful, hateful, discriminatory, or violent causes;
  • Transmit material that may be harmful to minors;

YOU WILL BE SOLELY RESPONSIBLE FOR ANY POTENTIAL DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM YOUR DOWNLOAD OF ANY SUCH INFORMATION, CONTENT OR MATERIALS.

C. WE ARE NOT RESPONSIBLE OR LIABLE FOR THE ACTIVITIES OR CONDUCT OF ANY THIRD-PARTY USER OF THE SERVICES.

Limitation of Liability

in no event shall we or our affiliates or any of our (or our affiliates’) directors, officers, employees, consultants, agents or representatives be liable under any theory of liability for any direct, indirect, incidental, special, or consequential damages of any kind, including, but not limited to, loss of data or loss of profits, arising out of or in any way connected to the use of or inability to use our tools, even if we have been advised of the possibility of such damages, including, without limitation, any damages caused by or resulting from reliance by any user on any information or content obtained from the site, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, or restriction, suspension or termination of access to the site.

Indemnification

You agree to indemnify, defend and hold us, our Affiliates, and our (and our Affiliates’) officers, directors, employees, agents, affiliates, service providers, successors and assigns harmless from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys’ fees and costs, arising from or relating to (i) your breach of these Master Terms or violation of applicable law; (ii) any user content you submit, post to or transmit through the Service; or (iii) your violation of any party’s rights, including, but not limited to, intellectual property rights, right of privacy, right of publicity and confidentiality.
